The law states that if you are found in possession of any alcohol beverage while you are in control of a commercial motor vehicle it is a 24 hour out of service ticket. Well the law defines having control of a commercial motor vehicle as being anywhere upon that vehicle. \n\nSo technically to do like I do. when I stop I go buy it and sit and watch tv and drink it then throw away the evidence is illegal.\n\nOn the other hand if there is a bar close and you walk over and have a few then go back to your truck even if you’re what could be classified as drunk it is legal.
